MCA declared Companies (Appointment and Qualification of Directors) Fifth Amendment Rules, 2020.

In the notification dated 18.12.2020, the Ministry of Corporate Affairs (MCA) has released the Companies (Appointment and Qualification of Directors) Fifth Amendment Rules, 2020 as a modification of the Companies (Appointment and Qualification of Directors) Rules 2014.

Under this amendment, MCA has increased the time period for passing an online proficiency test. This test conducted by the institute is to be cleared by each individual whose name is mentioned in the data bank and the duration for the same has been changed from 1 year to 2 years. Only a total of 50% weightage is required to clear the exam.

Furthermore, those individuals that have served as designated directors, in the Central Government specified organizations, for a time period of not less than 3 years are not required to apper for this exam. Foreign Directors as well as Bureaucrats/Public officials are also exempted from appearing for the test.
